Terms of Service

These Terms of Service ("Terms") govern your use of the KushAI: Eat Healthy mobile application ("KushAI", "the App") developed by Rustam Azizov ("we", "us", "our"). By downloading, installing, or using KushAI, you agree to these Terms. If you do not agree, do not use the App.
1. Description of Service
KushAI is a nutrition tracking application that allows you to:
- Log food entries manually or via AI-powered photo analysis
- Track daily calorie and macronutrient intake (protein, fat, carbohydrates)
- Track water intake
- Chat with an AI-powered nutritionist
- View nutrition statistics, health scores, and AI-generated nutrition analysis
- Receive push notification reminders
2. Eligibility
You must be at least 16 years old to use KushAI. By using the App, you represent that you meet this age requirement.
3. Account Registration
- You may create an account using email/password, Google Sign-In, or Apple Sign-In.
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity that occurs under your account.
- You agree to provide accurate profile information. Inaccurate data (such as incorrect weight or height) will affect the accuracy of nutritional calculations.
4. Subscriptions & Payments
Important: Subscriptions are billed through your Apple ID (App Store) or Google account (Google Play). All payment processing is handled by the respective platform. We do not collect or store payment information.
4.1 Plans
- Monthly: $10.99/month
- Yearly: $64.99/year
Prices may vary by region and are displayed in your local currency in the App Store or Google Play. Prices are subject to change; any changes will apply to the next billing cycle after notice.
4.2 Billing
Subscriptions are billed immediately upon purchase. No free trial is offered. Access to premium features begins as soon as the payment is confirmed.
4.3 Auto-Renewal
Subscriptions automatically renew at the end of each billing period (monthly or yearly) unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
4.4 Managing & Canceling Subscriptions
On iOS (Apple):
- Open Settings on your device
- Tap your name → Subscriptions
- Select KushAI and tap Cancel Subscription
On Android (Google Play):
- Open the Google Play Store app
- Tap your profile icon → Payments & subscriptions → Subscriptions
- Select KushAI and tap Cancel subscription
Cancellation takes effect at the end of the current billing period. You will retain access to premium features until then. Deleting the app does not cancel your subscription.
4.5 Refunds
iOS: Refunds are handled by Apple. Visit reportaproblem.apple.com.
Android: Refunds are handled by Google. Visit Google Play Help.
5. Referral Program
- KushAI operates an affiliate referral program outside the App. Referrers are onboarded through our Telegram bot (@kushai_partner_bot) and earn a commission on subscriptions made by users they refer.
- Referral codes are used only for attribution tracking. They do not unlock, discount, or modify any subscription, feature, or digital content in the App. All subscriptions are billed at the standard price through In-App Purchase.
- Commissions are paid out to referrers in USDT (TRC-20) after a 14-day hold period and are subject to a minimum payout threshold.
- We reserve the right to modify or discontinue the referral program at any time.
- Abuse of the referral program (e.g., creating fake accounts) may result in account termination and forfeiture of pending commissions.
6. AI Features — Disclaimer
KushAI is not a medical device and does not provide medical advice, diagnosis, or treatment.
- AI-powered food analysis, calorie/macro estimates, nutrition analysis, and chat responses are generated by artificial intelligence (OpenAI GPT-4o) and may contain inaccuracies.
- Nutritional values are estimates and should not be relied upon for medical dietary requirements.
- The AI nutritionist chat is for general educational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment from a qualified healthcare provider, and does not create a medical professional–patient relationship.
- The AI assistant is instructed to decline questions involving medical conditions, medications, pregnancy, breastfeeding, eating disorders, pediatric nutrition, or clinical symptoms, and to redirect users to a registered dietitian or physician. It does not diagnose conditions, prescribe treatments, or interpret lab results.
- Always consult a doctor, registered dietitian, or other qualified health professional before making significant changes to your diet, especially if you have medical conditions, allergies, or eating disorders.
- If you are experiencing a medical emergency, call your local emergency number immediately. If you are struggling with disordered eating, please contact a qualified professional or a local eating disorder helpline.
- Health scores and nutrition analyses are algorithmic assessments based on general public health guidelines and may not be appropriate for your individual circumstances.
7. Scientific Sources
KushAI's nutrition calculations, macronutrient targets, and general nutrition guidance are grounded in the following peer-reviewed research, official government databases, and public health guidelines. The same list is available in the app at Profile → Scientific Sources and from the disclaimer on the AI chat screen.

The information KushAI provides is general educational content derived from these sources. It is not medical advice and is not a substitute for consultation with a licensed healthcare professional.
8. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse-engineer, decompile, or disassemble the App
- Circumvent rate limits or usage restrictions on AI features
- Upload content that is illegal, harmful, or violates third-party rights
- Create multiple accounts to abuse referral programs or AI usage limits
- Use automated scripts, bots, or other tools to access the App
- Interfere with or disrupt the App's infrastructure
We reserve the right to suspend or terminate accounts that violate these Terms.
9. Usage Limits
To ensure fair usage, certain AI-powered features have daily limits:
- Food photo analysis: 30 requests per day
- Nutrition analysis: 10 requests per day
- AI chat messages: 50 messages per day
These limits may be adjusted. The App will inform you when you approach or reach a limit.
10. Intellectual Property
- KushAI, its design, code, branding, and content are the property of Rustam Azizov and are protected by applicable intellectual property laws.
- You retain ownership of content you create (food entries, photos, chat messages). By uploading content, you grant us a limited license to process, store, and transmit it solely to provide the service.
- You may not use the KushAI name, logo, or branding without written permission.
11. Privacy
Your use of KushAI is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
12. Disclaimers
- KushAI is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied.
- We do not guarantee the accuracy of AI-generated nutritional information.
- We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
- We are not responsible for decisions you make based on information provided by the App.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Rustam Azizov shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the App. Our total liability for any claim arising from these Terms or your use of KushAI shall not exceed the amount you paid for the App in the 12 months preceding the claim.
14. Account Deletion
You may request deletion of your account and associated data at any time by contacting support@kushai.app or through the in-app account settings. Upon deletion:
- Your personal data, food entries, photos, and chat history will be permanently deleted within 30 days.
- Active subscriptions must be canceled separately through your Apple ID or Google Play settings.
15. Termination
We may suspend or terminate your access to KushAI at any time if you violate these Terms, abuse the service, or engage in fraudulent activity. You may stop using the App at any time.
16. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the App or by email. Continued use of the App after changes constitutes acceptance of the updated Terms.
17. Governing Law
These Terms are governed by the laws of the Republic of Azerbaijan, without regard to conflict of law principles. For consumers in the European Union, this does not affect your statutory rights under the laws of your country of residence.
18. Platform-Specific Terms
17.1 Apple (iOS)
The following terms apply to the extent you use KushAI on an Apple device:
- These Terms are between you and Rustam Azizov, not Apple Inc. Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- In the event of any failure to conform to applicable warranties, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation.
- Apple is not responsible for any claims relating to the App, including product liability, regulatory compliance, or intellectual property infringement.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
17.2 Google (Android)
The following terms apply to the extent you use KushAI on an Android device:
- These Terms are between you and Rustam Azizov, not Google LLC. Google is not responsible for the App or its content.
- Google has no obligation to provide maintenance or support for the App.
- Subscriptions and payments are processed through Google Play. Google Play's terms of service and refund policies apply to all transactions.
